1. Acceptance of Terms

By accessing or using TinyURL.ca ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by IRA Next Inc., a Canadian corporation.

2. Description of Service

TinyURL.ca provides URL shortening services that allow users to create short, trackable links. We offer both free and paid subscription tiers with varying features and limitations.

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One person or entity may maintain only one free account
• You are responsible for all activity under your account

4. Acceptable Use Policy

4.1 Prohibited Uses

You may not use the Service to:

• Link to illegal content or engage in illegal activities
• Distribute malware, viruses, or malicious code
• Engage in phishing, fraud, or deceptive practices
• Link to content that infringes intellectual property rights
• Harass, abuse, or harm others
• Distribute spam or unsolicited communications
• Link to adult content, violence, or hate speech
• Circumvent our rate limits or abuse our API
• Impersonate others or misrepresent your affiliation
• Interfere with or disrupt the Service

4.2 Enforcement

We reserve the right to investigate and take appropriate action against users who violate these Terms, including removing content, suspending accounts, and reporting to law enforcement.

5.1 Free Tier

• 10 shortened links per month
• Basic click tracking
• 30-day analytics retention
• Standard support

5.2 Pro Tier

• Unlimited shortened links
• Advanced analytics
• Unlimited analytics retention
• QR code generation
• Priority support

6. Payment Terms

6.1 Subscription Fees

Pro subscriptions are billed monthly at $9 CAD per month. Prices are subject to change with 30 days notice.

6.2 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method.

6.3 Refund Policy

Subscription fees are non-refundable. You may cancel your subscription at any time, and it will remain active until the end of your current billing period.

6.4 Cancellation

You can cancel your subscription at any time through your account settings. Upon cancellation, you will retain Pro features until the end of your billing period, then automatically downgrade to the free tier.

7. Intellectual Property

7.1 Our IP

The Service, including its source code, design, and content, is owned by IRA Next Inc. and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of the URLs you shorten. By using the Service, you grant us a license to store, process, and display your URLs and analytics data as necessary to provide the Service.

8. Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or due to factors beyond our control. We are not liable for any losses resulting from service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRA NEXT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless IRA Next Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service immediately ceases.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
